ELC BATTLES STATE ON BEHALF OF DYSLEXIC STUDENT

A.W., a student denied appropriate education services to treat his dyslexia for more than ten years, has reached a settlement with his local school district, the terms of which must remain confidential. However, his claims against the State remain unresolved. In a long-running battle, ELC and co-counsel have fought to remedy the systemic failures of the New Jersey Department of Education to ensure that A.W. learn to read while receiving special education and related services in the public schools of the State.

ELC and former co-counsel Jeffrey Fogel, Esq. defeated the State’s first round of motions to dismiss A.W.’s lawsuit in a case decided by the Third Circuit Court of Appeals in August 2003. ELC and current co-counsel Stephen Latimer, Esq. recently filed an opposition brief in response to the State’s second round of motions to end the case, arguing that it must proceed to trial.
