RE: Supreme Court Order on Pre-K Appeals

On January 23rd, the Supreme Court issued the attached Order establishing a schedule for appeals of Department of Education (DOE) decisions on the Abbott districts preschool plans and budgets for 2003-04.

The Court’s order fixes firm dates for the processing of your districts’ appeals, with final review by the Superior Court, Appellate Division set for May 14, 2003.

ELC again emphasizes that the deadline for the filing of administrative appeals is February 5th. Appeals cannot be filed after that date.

ELC has received inquiries from districts raising concerns over reductions/cuts by the DOE in requested transportation, services and funding for 2003-04. ELC encourages districts to make every attempt to resolve these issues with DOE prior to February 5th. If, however, your district cannot resolve the issues before that date, ELC recommends an appeal be filed so that your district can continue to seek needed pre-K transportation, programs, services and funding, either through settlement of the appeal or through a hearing and decision.

As always, ELC is available to assist you in your efforts to ensure that all of your districts’ preschool children are provided with well planned, high quality preschool programs ordered by the NJ Supreme Court.

Abbott Preschool Schedule as Filed by the Court on January 23, 2003


February 5, 2003 - Filing of administrative appeals and transmittals by the Commissioner to the Office of Administrative Law

March 14, 2003 - Issuance of Initial Decision by an Administrative Law Judge, including itemization of the record

April 14, 2003 - Filing a Notice of Appeal with the Appellate Division of Superior Court

May 14, 2003 - Resolution of the Appellate Division appeal
