SUMMARY OF THE ABBOTT
X COURT ORDER
- Withdrawal
of the State’s motion to eliminate the Abbott mandates for whole school
reform (WSR) and supplemental programs.
- Continued
implementation of WSR in all elementary schools using national models
as the preferred strategy
- Designation
of “high performing schools” to be given the option to continue with
the selected WSR model or to modify it, replace it with another model,
or implement an alternative whole school reform design.
- Designation
of “low performing schools” to be assigned an independent Performance
Assessment Team. The Team will
identify barriers to higher student achievement, and will
facilitate an agreement on needed improvements.
- WSR
contract restoration in schools where such contracts were improperly
terminated over the past two years.
- An
investigation process within NJDOE to resolve complaints from either
schools or developers over WSR contract performance.
- Policy
and regulation for WSR in middle and high schools for the 2004-05
school year, to be developed by stakeholders and experts convened
by DOE and ELC.
- Implementation
of all Abbott V supplemental programs with program design and intensity
based on student need.
- Supplemental
funding for 2004-05 and thereafter based on school and district demonstration
of need.
- Replacement
of proposed Abbott regulations with new draft regulations consistent
with all Abbott decisions and mediation agreements.
- Review
and consensus on draft regulations by a committee of stakeholders
and experts, jointly established by DOE and ELC, to be completed by
September 2003.
- Expedited
schedule for DOE decisions and appeals on district budgets for the
2003-04 school year and thereafter.
- An
expedited schedule annually for DOE decisions and appeals on preschool
budgets.
- Establishing
bid specifications for a DOE-funded evaluation of Abbott implementation
by a committee of experts and stakeholders, jointly established by
DOE and ELC.
