| In addition
to these requirements, N.J.A.C . 6A:24-3.3(b) provides that the
"board shall cooperate with or utilize
a DHS-licensed child care provider whenever practical to
implement required . . . programs and shall not duplicate programs
or services otherwise available
in the community."The regulation
provides that when such arrangements
are made for DHS-approved providers to conduct programs, the contract
for such services shall be in a
Department-approved form containing clear expectations,
necessary supports and accountability measures. The DHS-approved provider
must agree to comply with the class
size and teacher-student ratio requirements established
in N.J.A.C. 6A:24-3.3(a)(3)
and must provide programs meeting the Expectations and
linked to the CCCS and integrated
as required in N.J.A.C . 6A:24-3.3(a)(4). Teacher
certification for existing teachers who do not hold the required academic
credentials must be brought up to
required levels and the P-3 endorsement obtained by September
2004, and other certification requirements for newly hired teachers
must be achieved by September
2001. N.J.A.C . 6A:24-3.3(b)(3), (4). The Board must operate
its early childhood
program consistent with its early childhood plan approved by the DOE
and "shall provide any necessary
information to the Department to ensure that the program implementation
is consistent with that plan." N.J.A.C .
6A:24-3.4(a). Finally, the regulations
provide that "[n]o additional early childhood education programs or
services shall be approved unless
a particularized need is demonstrated pursuant to N.J.A.C.
6A:24-5."

to the regulations the DOE also issued the Abbott Preschool
Educational Program Contract ("Contract "), a document
incorporating and elaborating upon
the requirements for the provision by outside providers of Abbott
preschool education programs. This
document addresses, among other items, the components of
such programs, the staff qualifications required, the terms of the
agreement and the termination procedures,
the compensation rates, the need for district/provider
coordination and cooperation, the record-keeping requirements, confidentiality
issues and the monitoring of program
