1Although the consolidation of the issues addressed in this decision was not originally accompanied by a severance of the consolidated cases and issues therein from the underlying individual district-related contested cases, including those brought by the Education Law Center (ELC), as this decision is issued, it appears that given the passage of time and the fact that a number of the underlying contested cases have been resolved in one or another fashion, it makes the most sense to issue this as an initial decision, limited to the issues addressed herein. This will assure that the Commissioner will review these overarching issues promptly and allow the eventual determination of the remaining contested cases in whatever may be the appropriate manner for each, without the continued pendency of those matters delaying review. It is not clear at this time that there will be any ultimate initial decisions in those cases, since they relate to a past, or an almost completed, school year. While in at least two cases reimbursement is sought for funds already expended, I deem it best to sever this decision from its underlying base. Therefore, the contested case has been renamed and a new docket number assigned. Counsel should use this new name and docket number in any future communications regarding the global issues, on review and on appeal. They should use the docket numbers of the underlying contested cases in regards to any district-specific matters. The listing of individual case names and dockets in the title of this decision reflects those matters still shown as open.
